"THE LAST WILL AND TESTAMENT"
OF
SAMUAL WARREN TEMPLE
IN THE NAME OF GOD, AMEN; I SAMUAL Warren Temple, of the Town of Mt.
Vernon, County of
Jefferson, and State of Illinois, of the age of Sixty Eight, years, being
of sound mind and memory, and
considering the uncertainty of this frail and transitory life do hereby
make, publish and declare this, my
LAST WILL AND TESTAMENT, in manner following, that is to say:
FIRST:- I order and direct that my Executors, hereinafter named, pay
all of my just debts and funeral
expenses as soon after my decease as conveniently may be. After the payment
of such debts and
funeral expenses
SECOND:- To make disposition of the remainder of my property as I do hereinafter direct.
I give, devise and bequeath to my beloved wife, Mary Elizabeth Temple
all my property whatsoever,
real, personal and mixed, for the term of her natural life, with remainder
to my son, Eugene Elmer
Temple, in fee simple, subject however to the following qualifications
and restrictions:
I direct that one fourth the income, over and above the expenses of
maintainance and operation
derived from all my property shall be paid over annually to my son the
said Eugene Elmer Temple
(handwritten in - by my said wife, Mary Elizabeth Temple) as long as they
both shall live.
I further direct that in the event my said son shall die before my said
wife, all my property, real,
personal,, and mixed , shall pass on her death, in fee simple to the Trustees
of the Epworth Methodist
Episcopal Church of Mt. Vernon, Illinois, for the sole use and benefit
of said Church forever.
LASTLY:- I hereby nominate and appoint Eugene Elmer Temple and Joel
F. Watson to be the
Executors without Bond of this, my LAST WILL AND TESTAMENT, hereby revoking
all former
Wills and Codicils by me made.
IN WITNESS WHEREOF, I have hereunto subscribed my name and affixed my
seal, the 17th, day
of March, in the year of our Lord, One Thousand Nine Hundred and Eight.

This Instrument was, on the day of the date thereof, signed, published
and declared, by the said
Testator to be his Last Will and Testament, in the presence of us, who,
at his request, have
subscribed our names thereto as witnesses, in his presence, and in the
presence of each other.

PERSONALLY APPEARED, in open Court, Charles W. Hall and W. A. Brown,
subscribing witnesses to the foregoing instrument of writing, purporting
to be the last
Will and Testament of Samual Warren Temple, late of Jefferson County, deceased,
who, being duly sworn according to law, do depose and say, each for himself,
that
the foregoing is the Last Will and Testament of the said Samual Warren
Temple, deceased;
that they subscribed their names thereto as the attesting witnesses, at
the request of the said
Testator and in his presence, and in the presence of each other, on the
17th. day of
March, A.D. 1908, that he then and there subscribed his name thereto in
their presence,
and declared the same to be his last Will and Testament; and that the said
Testator at the
time of executing the same as aforesaid was of full age, of sound mind
and memory, and
under no constraint.
